MICHAEL ALLEN: In Ohio, driving under the influence is now commonly referred as OVI, operating a vehicle under the influence. Law enforcement officers are extremely aggressive in apprehending OVI offenders and prosecutors are extremely aggressive in prosecuting those offenders.
I counsel my clients almost exclusively not to submit to the breath test, not to submit to any roadside tests that the officer asks you to do. Answer the police officer's questions with respect to who you are and what your identifying information is. Be polite with the police officer. Be respectful. But you're not legally obligated to tell that police officer anything more.
KIP GUINAN: OVI is what we call an enhancement charge. If convicted of an OVI this year and for example you were to get another OVI charge next year, your penalties will be enhanced because of your prior conviction. We do not recommend anybody go into court un-counseled and plead out to an OVI.
The new law in Ohio has what's called a 20-year look back. So if you are convicted in 2009 and then have a new charge in 2019, you still face enhancement penalties. It's important to have experienced counsel with you each step of the way when facing an OVI charge.
